To increase housing supply within NSW the NSW Government has required all councils to permit dual occupancy housing across all land zoned R2 (Low Density Residential), except for land that has bushfire risk, or a heritage item, or within a Transport Oriented Development area.
The NSW Government is giving 13 councils, including Ku-ring-gai, the opportunity to nominate a minimum lot size for dual occupancy development to manage the impacts of small lots sizes within established areas.
Council developed two options for dual occupancy development that:
- meet the NSW Government’s requirements to deliver dual occupancies on 50% of Council’s R2 (Low Density Residential) land; and
- seek to manage impacts on Ku-ring-gai’s high quality garden character, including tall canopy trees and heritage conservation areas.
Local Housing Areas
The NSW Government has delineated draft Local Housing Areas around train stations and around Local Centres that have a large supermarket and facilities.
The Local Housing Areas are based on a 400m and 800m walking distance from the Centres. Currently detailed mapping of the Local Housing Areas has not been provided by the NSW Government.
As such we can only provide an indicative map of the draft Local Housing Areas.
In the Local Housing Areas the NSW Government will set a 450sqm minimum lot size and 12m lot width requirement for dual occupancy developments that are lodged via the development application process only. These and other standards will be placed in the State Environmental Planning Policy (Housing) 2021.
As part of this engagement process, and as outlined in the options below, Council consulted on the minimum lot size for development applications outside Local Housing Areas and complying development applications across the council area.

Minimum lot width
A minimum lot width of 18m is proposed for lots developed via a development application outside a Local Housing Area.
